Anthropic Starts Digitally Watermarking All Text Claude Generates, Because of the EU AI Act

Starting in August, any text that comes out of Claude carries an invisible signature — whether the person who asked for it is in Brussels or in Guatemala. It's the first time an EU obligation changes a frontier model's behavior for the entire planet at once.

What Article 50 Requires

The transparency obligations of Article 50 of the EU AI Act took effect on August 2, 2026, and require AI systems that generate synthetic content — including deepfakes and text — to mark it as artificially generated. Non-compliance can result in fines of up to 15 million euros or 3% of the company's annual global revenue, whichever is greater.

How Claude's Watermark Works

Anthropic applies the marking in two different ways depending on the output type. For text, the watermark subtly biases the model's word choices in a way that's statistically detectable over a large enough volume of content, and that pattern travels with the text even if it's copied and pasted elsewhere. For files, the C2PA provenance metadata standard is used, which signals Claude's involvement and helps detect later manipulation.

The Fine Print: What the Watermark Doesn't Prove

Anthropic explicitly warns against treating either signal as definitive proof of authorship. Claude can process material originally created by a person — someone can use the model to translate, summarize, or edit an existing text, and the result can still carry Claude's mark even though the intellectual authorship is human.

Why It Matters Even If Your Company Isn't in the EU

Anthropic decided to apply the watermark globally instead of only to European users, confirming a pattern that was already emerging: when a frontier lab complies with a strong regulation from a single market, the simplest way to implement it technically ends up being applying it to all users, not segmenting model behavior by geography. For legal and compliance teams in Latin America, this means EU AI Act rules are already shaping the product they use today, without their company having had to do anything.
